Welcome to Lumen / Lore ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of www.lumen-lore.com (the "Site") and any purchases made through the Site.

By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1) About Lumen / Lore

Lumen / Lore is the online shop and portfolio of Jeremy Bible ("Artist/Photographer"), offering original watercolour paintings and professionally produced photographic prints and products.

2) Eligibility and account responsibility

You must be able to form a legally binding contract in your jurisdiction to use the Site and purchase products. If you create an account, you are responsible for keeping your login information confidential and for all activity under your account.

3) Products and color/appearance

We aim to display product images and descriptions as accurately as possible. However:

• Colors can vary depending on your monitor/device and display settings.

• Handmade originals (watercolour paintings, framing) may have minor natural variations.

• Print products (paper, canvas, metal) may have slight variations due to materials and production processes.

4) Orders and acceptance

Placing an order is an offer to buy. We may accept, decline, or cancel an order at our discretion, including for reasons such as:

• suspected fraud or unauthorized payment activity

• incorrect pricing or listing errors

• inventory/availability issues (including one-of-a-kind originals)

If we cancel an order after payment, we will issue a refund to the original payment method.

5) Pricing, currency, taxes, and fees

Prices are shown on the Site and may change at any time. Unless stated otherwise:

• Prices do not include shipping, duties, or taxes, which may be added at checkout.

• You are responsible for any applicable taxes, customs fees, import duties, or carrier brokerage fees imposed by your region.

6) Payments (Stripe)

Payments are processed through Stripe. By purchasing, you agree to provide current, complete, and accurate payment information. We do not store full payment card numbers. Payment processing may be subject to Stripe's terms and policies.

7) Shipping, delivery, and risk of loss

Shipping timelines are estimates and may vary due to carrier delays, production times (for prints), weather, or other factors.

Unless otherwise required by law:

• Risk of loss and responsibility for a package transfers to you once the package is handed to the carrier.

• If tracking shows "delivered" but you cannot locate your package, please contact the carrier first and then email us at support@lumen-lore.com so we can assist where possible.

8) Print production and fulfillment (photographic products)

Professionally printed photographs (including framed/matted prints, canvas prints, and metal prints) may be produced by a professional lab and shipped directly to you. By placing an order, you authorize us to share necessary information (such as your name and shipping address) with the lab and shipping carrier solely to produce and deliver your order.

9) Returns, exchanges, cancellations, and damaged items

Because product types vary, the following approach is typical for art ecommerce.

A. One-of-a-kind original paintings

All sales are final unless the item arrives damaged or you receive the wrong item.

B. Professionally printed photo products

Because prints are typically made-to-order, returns for change-of-mind are not accepted unless required by law.

If your print arrives damaged, defective, or incorrect, we will work with you to replace it or refund it, depending on the circumstances.

C. Damage and issues

Please inspect your order upon delivery and contact us within 7 days of delivery if:

• the item arrives damaged

• you receive the wrong item

• there is a defect or quality issue

Include your order number, photos of the item, and photos of the packaging.

D. Cancellations

Orders for made-to-order prints may enter production quickly. If you need to cancel, contact us immediately. If production has started or an original has shipped, cancellation may not be possible.

10) Intellectual property and permitted use

All content on the Site—including artwork, photographs, images, text, and design elements—is owned by Jeremy Bible or licensed to us and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, sell, or create derivative works from our content without prior written permission, except as allowed by law.

11) Purchases do not transfer copyright

Buying a physical artwork or print does not transfer copyright or reproduction rights. You may display the purchased item for personal use, but you may not reproduce the image (e.g., prints, merchandise, NFTs, commercial use) without written permission.

12) Prohibited activities

You agree not to:

• use the Site for unlawful purposes

• attempt to interfere with the Site's security or functionality

• scrape, crawl, or harvest data from the Site without permission

• submit false or misleading information

• infringe on our intellectual property or the rights of others

13) Third-party links

The Site may contain links to third-party websites or services. We are not responsible for third-party content, policies, or practices.

14) Disclaimer of warranties

The Site and products are provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee that the Site will be uninterrupted, error-free, or secure.

Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

15) Limitation of liability

To the maximum extent permitted by law, Lumen / Lore and Jeremy Bible will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Site or purchase of products.

In all cases, our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

16) Indemnification

You agree to indemnify and hold harmless Lumen / Lore and Jeremy Bible from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site, violation of these Terms, or infringement of any rights.

17) Privacy

Your use of the Site is also governed by our Privacy Policy at www.lumen-lore.com/privacy.

18) Governing law and venue

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. You agree that disputes will be resolved in the courts located in Ontario, unless applicable consumer protection laws require otherwise.

19) Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new effective date. Your continued use of the Site after changes means you accept the updated Terms.
